EA Sports Active Hit with Trademark Lawsuit

EA Sports Active has been hit with a trademark lawsuit. Trademark lawsuits are common and require the assistance of a lawyer who has experience with business litigation. If you are involved in a trademark dispute, you should contact a New York business lawyer who can help you determine your rights and defend your business's best interests.

EA Sports Active is being sued by the Active Network for trademark infringement. The Active Network has been around since 2008 and has held the rights to the word "active" in regards to information such as:

  • Scheduling of participatory sports, sporting events and recreational activities; and
  • Services for sports training (i.e. personal training programs).

In competition with the Active Network, EA Sports came up with Active 2.0 which provides some of the very same functions as the Active Network. The Active Network claims that EA Sports Active's scheduling and fitness goals cover purposes for which they hold the trademark "Active."

Not only does the Active Network seek that the name "Active" not be promoted but they are also seeking punitive damages in excess of $75,000.

Trademark disputes can be complicated and can quickly get expensive. Contact a New York business lawyer who can assist you with business litigation.
