Franchise Acts in Other States

Every franchise in the United States is subject to the Federal Trade Commission's Franchise Rule of 2007. In addition, each individual state and the District of Columbia has the authority to establish additional rules for franchises.

The state rules are known as franchise acts and each state will have its own unique laws and regulations which all franchises must follow. Some states are more lenient than others and may have only a few rules, if any. Others may have a plethora of guidelines and other requirements which can make franchising there more difficult than other states.

When considering multi-state franchising, discuss the matter with your New York franchise lawyer first to determine if it is a good move for your franchise. Some franchises lend themselves better to multi-state franchising than others, so it's important to determine your potential first before making any big decisions.

Your best course of action is to consult with your New York franchise lawyer. Doing so early in the franchise development process can reduce the amount of work you need to do later. However, franchising in other states can be considered at any time, whether you are a start-up franchise or an established franchisor.

If you decide to start franchising in other states, your lawyer can help you obtain the franchise acts for each state and determine the necessary steps to prepare your franchise disclosure document (FDD). Some states will not require any additional work, while others may require changes in your FDD.
