The FTC’s New Rule For Starting a Franchise in New York

When starting a franchise in New York, you will be required to abide by the Federal Trade Commission's (FTC) New Rule. The New Rule establishes guidelines for starting a new franchise, as well as for the franchise disclosure process. This includes strict rules regarding the provision of a Franchise Disclosure Document (FDD).

If you have questions regarding the FTC's New Rule, or for assistance with the disclosure process, you can get the help of an experienced New York Franchise attorney.

The New Rule outlines required procedures such as the timing and delivery of franchise disclosures, and the contents of the FDD.

The contents of the FDD must include information such as:

  • Your company's business and litigation history;
  • An estimate of the initial investment of the franchisee, including franchise fees, financing, and the necessary goods and/or services; and
  • The franchisee's obligations, such as site maintenance, contributions toward advertising costs, and the use of intellectual property.

These are only a few of the FTC's franchise disclosure requirements. In fact, there are 23 items which must be listed within the FDD and each item must be provided according to the FTC's guidelines.

To learn more about the required guidelines, or to get help drawing up your Franchise Disclosure Document, you can get the professional help of a New York franchise lawyer. In the meantime, you can learn more about the FTC's franchise rules and guidelines by visiting our article library.
