Time Limit to Renew a Trademark

If you plan to renew a trademark in New York, there is a specific time limit in which you must file for renewal of your mark. To renew a trademark, the owner must file a Declaration of Continued Use and an Application for Renewal between the 9th and 10th years after the original registration date.

If you are late in filing these documents with the United States Patent and Trademark Office (USPTO), they will be also be accepted if filed within 6 months after the deadline. If you do file late, there will be an additional fee required.

Because the timing of these 2 filings coincide, the USPTO has created a form called the Combined Declaration of Use in Commerce and Application for Renewal of Registration of a Mark, which can be found in electronic form at the USPTO website.
