Can a Franchisor Disclose its FDD "Electronically" to a Prospective Franchisee under the Federal Franchise Rule.
A: Yes. The federal franchise rule permits a franchisor to electronically disclose its FDD to a prospective franchisee. Forms of electronic disclosure may include electronic mail and secure website access.
The electronic disclosure must, among other things, permit the franchisee to store and print the FDD in its entirety.
