How to Franchise my Business.

A: For the entrepreneur who has established a successful business "franchising your business" requires compliance with the Federal Franchise Rule and State Specific franchise regulations.  To franchise your business - prior to offering or selling a franchise -  you be required to prepare a "Franchise Disclosure Document ("FDD")  which must be registered and filed in certain states known as the "franchise registration states".

For the typical start-up franchisor the method for franchising your business should include a review and consultation with an experienced franchise lawyer to assess your trademarks (including the need to file trademark registrations, review your business systems and methods of operation, understand your goals as a "prospective franchisor" and the preparation of a FDD that is unique to your business and satisfies both federal and state franchise laws.
