What needs to be done to offer and sell a franchise in Maryland?

A: Franchisors interested in offering or selling a franchise in Maryland must first register their franchise with the State of Maryland. This is done by submitting the franchised businesses' franchise disclosure document ("FDD") to the Maryland Securities Division along with a franchise application and any other applicable documents or fees required by Maryland. Once the franchisor's application to register the franchise has been approved the franchisor may begin offering and selling franchise units in the state of Maryland.

Also remember that prospective franchisees must be given a copy of the franchise disclosure documents at least 14 calendar days before the execution of the franchise agreement.
