What needs to be submitted to properly register a franchise in Virginia?

 

A: To properly register a franchise in Virginia the following information should be submitted:

  • Uniform Franchise Registration Application page;
  • Total Costs and Sources of Funds for Establishing New Franchises form;
  • Uniform Consent to Service of Process form;
  • An authorizing resolution if the application is a corporation or partnership;
  • Franchise Disclosure Document;
  • Application fee (payable to the "Treasurer of Virginia"); and
  • Auditor's consent to the use of the latest audited financial statements in the FDD.

Please not that if the date of the most recent audited fiancial statements in the FDD precedes the date of the application by more than 120 days the FDD must also include the following financial information:
  • An unaudited interim balance sheet as of a date within 120 days of the date of the application; and
  • An unaudited statement of income or operation for the period fromthe most recent audited financial statements to the date of the interim balance sheet.
