Franchise Amendment Application Process in Maryland
Franchise amendment registration applications in Maryland should be submitted promptly after an amendment is made to your Franchise Disclosure Document ("FDD"). Updates to your FDD are critical to ensure that your franchise system is and remains in regulatory compliance. The state of Maryland is a franchise registration state and, among other things, requires that a current and accurate copy of the FDD be maintained on file. In the state of Maryland franchise disclosure documents must be updated no less than annually but sooner if material changes occur. Modifications respecting FDD Item 19 must be immediately disclosed.
Applications to amend your franchise registration must be mailed to the Maryland Securities Division with a check in the amount of $100.
The franchise amendment application is normally reviewed by the Maryland Securities Division within 15 business days of filing the amendment. Shortly after the allotted amount of time for review a letter should be sent out notifying you of the effective date or a deficiency letter if there are problems with the amendment application.
