Information to Include on Your Renewal Application When you renew a trademark, your Application for Renewal must include the following:
a request to renew the registration signed by you or your representative (such as your New York trademark lawyer if he or she has been given such a power of attorney);
the trademark registration number, mark and date of registration;
the current name and address for correspondence;and
the filing fee.
When you renew a trademark, your Declaration of Continued Use must also include detailed information. You'll need to include the following on your Declaration of Continued Use:
your trademark registration number;
the current name and address of the trademark owner;
the filing fee;
if the mark is currently in use, a statement that the registered mark is currently in use in commerce;
a list of the goods and/or services that are connected with the mark;
one specimen for each class of goods and/or services (product labels, advertisements, etc.); and
an affidavit or declaration that is signed and dated.
Once you have filed your Declaration of Continued Use and application to renew a trademark, your application will be reviewed by a specialist in the Post-Registration Division. If your renewal is accepted, you will receive a Notice of Acceptance from the USPTO. If your renewal is refused, you will receive an Office Action stating the reasons for refusal and a list of steps for remedies.
