Is New Jersey a Registration State?

When franchisors sell or offer for sale their franchise opportunities in the state of New Jersey they typically have questions relating to:
  1. Whether or Not New Jersey a registration state? The answer is that it is not. However‚ to sell a franchise in New Jersey you must maintain a current and updated FDD that satisfies the federal FTC Franchise Rule and  disclosure obligations.
  2. Whether or Not You Need to Register Your FDD in New York? You must be aware that when you are selling a franchise in New Jersey that‚ geographically‚ you are close to New York State—a state that has very strict registration requirements. So‚ although not required‚ we strongly recommend that you also register your FDD in New York.
